Our Health & Safety Policy


KidsArt! Health and Safety Policy

  1. Our Commitment

KidsArt! is committed to ensuring, as far as is reasonably practicable, the health, safety, and wellbeing of everyone in our sessions — children, teachers, helpers and visitors alike.

This policy applies to all KidsArt! activities, including regular classes, holiday sessions, and birthday parties.

KidsArt! ensures that all classes and activities are conducted safely, using non-toxic, child-safe art materials and appropriate levels of supervision at all times.

  1. Roles and Responsibilities

2.1 Director

The KidsArt! Director oversees all health and safety matters, including:

  • Making sure KidsArt! meets its legal duties.
  • Directing staff to know and follow safety procedures.
  • Reviewing and updating this policy at least once a year.

2.2 Teachers

Teachers are responsible for:

  • Keeping themselves and others safe.
  • Supervising children at all times.
  • Checking that materials and equipment are safe.
  • Following emergency procedures for each venue.
  • Reporting hazards, accidents, or concerns immediately
  1. Risk Assessments

KidsArt! carries out risk assessments for all activities. These assessments:

  • Identify and manage potential hazards.
  • Are shared with teachers so they know the safety measures to follow.
  • Are reviewed whenever new activities or venues are introduced
  1. Fire Safety
  • Teachers must know the location of fire exits, alarms, and assembly points.
  • Fire exits must always be kept clear.
  • Children should be led calmly to the assembly point if evacuation is needed.
  • Fire systems and drills are managed by the venue.
  1. First Aid and Accidents
  • A first aid kit is available at every session.
  • At least one staff member holds a paediatric first aid certificate.
  • Significant incidents — injuries requiring medical attention or that could have caused serious harm — are recorded in the KidsArt! Accident Book.
  • Minor scrapes and bumps are treated immediately and noted if necessary.
  • Parents or guardians are informed about any incident involving their child.
  • Serious incidents are reported to the authorities if required by law
  1. Safe Materials and Equipment
  • Only non-toxic, age-appropriate art materials are used.
  • Children are supervised when using scissors, craft tools, or other equipment.
  • No hazardous substances, aerosols, or solvents are used.
  • Surfaces and hands are cleaned after each session.
  1. Safeguarding

KidsArt! follows a separate Safeguarding Policy Statement.
All staff are DBS checked, and children are supervised at all times.

  1. Reviewing the Policy

This policy is reviewed at least once a year, or sooner if legislation changes or new activities are introduced.
All staff are informed of updates and must follow the current procedures.

Our Safeguarding Policy Statement


Note: The terms ‘child’ and ‘young person’ describe any person under the age of 16. References to ‘parents’ should be read as parents and carers inclusively.

KidsArt! Statement:  KidsArt! acknowledges the duty of care to safeguard and promote the welfare of children and is committed to ensuring that safeguarding practice reflects statutory responsibilities, government guidance and complies with best practice requirements.

The policy recognises that the welfare and interests of children are paramount in all circumstances. It aims to ensure that regardless of age, ability or disability, gender reassignment, race, religion or belief, sex or sexual orientation, socio-economic background, all children:

  • have a positive and enjoyable experience of art in a safe and child-centred environment
  • are protected from abuse whilst participating in KidsArt! activities

Our Policy:  As part of our safeguarding policy we will:

  • promote and prioritise the safety and wellbeing of children and young people
  • value, listen to and respect children
  • ensure robust safeguarding arrangements and procedures are in operation
  • adopt safeguarding best practice through our policies, procedures and code of conduct for staff and volunteers
  • ensure everyone understands their roles and responsibilities in respect of safeguarding

KidsArt! safeguarding statement:  We will:

  • provide effective management for staff and volunteers through supervision and support, so that all staff and volunteers know about our policies, procedures and behaviour codes and follow them confidently and competently
  • ensure appropriate action is taken in the event of incidents or concerns of abuse and support provided to the individual(s) who raise or disclose the concern
  • ensure that confidential, detailed and accurate records of all safeguarding concerns are maintained and securely stored
  • record and store information securely, in line with data protection legislation and guidance
  • prevent the employment or deployment of unsuitable individuals by recruiting and selecting staff and volunteers safely, ensuring all necessary checks are made
  • appoint a nominated safeguarding lead for children and young people
  • share information about safeguarding and good practice with children and their parents as appropriate
  • make sure that children, young people and their parents know where to go for help if they have a concern
  • ensure that everyone involved in teaching children will be given access to appropriate learning opportunities to recognise, identify and respond to signs of abuse, neglect and other safeguarding concerns relating to children and young people

The policy and procedures are mandatory for everyone involved in KidsArt! Failure to comply with the policy and procedures will be addressed without delay and may ultimately result in dismissal or exclusion from KidsArt!

This policy will be reviewed annually, and also as required by changes in legislation and/or government guidance.

Terms of Use

Studio Leader/Assistant – Your contract


APPROVED

Studio:  KidsArt! Studio in Finchley N12 or as otherwise agreed on appointment. 

Fees:  Separate rates for term time classes and holiday programmes, each as from time to time agreed on appointment.

Hours:  As agreed on appointment and to include sufficient time for set up and clearing.  Please allow sufficient travelling time to ensure prompt arrival.

Injury / illness:  Please do let us know as soon as you can if you cannot attend any class so we can either arrange a substitute or, worst-case, cancel. 

Duties:  Set up classroom and clear after lesson (including washing palettes, jars and brushes and cleaning table and hoovering).  Deliver lesson as planned.  Ensure health and safety of the children attending.  Safe keeping of KidsArt! materials and children’s art works and personal possessions.  Conduct yourself professionally at all times when dealing with children and adults.  Report on attendance, any direct payments, fresh enquiries, etc.

Employment and tax status:  You are not a KidsArt! employee, as your work will be part-time only (typically only a few hours a week) and we appreciate that you will undertake other work/educational courses that take up the rest of your time.  You are therefore responsible for any personal tax and national insurance payable and will reimburse KidsArt Limited for any employment taxes, National Insurance, etc. it incurs which you should pay as a self-employed worker.

KidsArt! Property:  At all times act to promote the interests of KidsArt! and respect its brand and proprietary trademarks, class programmes, art-works, know-how, web content, copyright materials and other intellectual property, photos and videos taken in KidsArt! sessions (together, ‘KidsArt! Property’).  No unauthorised use of any KidsArt! Property and KidsArt! Property should not be stored on your personal devices (phones, etc.) but deleted after the end of each term.  Keep personal data confidential. Any images of children and  / or their artwork taken on your personal devices should be taken only for sending back to KidsArt! and deleted immediately thereafter.

Private tuition, etc.:  Occasionally, you may be asked if you can provide private tuition, run private parties, etc. for KidsArt! enrolled students or students that KidsArt! teaches privately or others where there is a KidsArt! connection. Please refer all such opportunities first to KidsArt! for consent and booking (if you accept without consent you agree to account to KidsArt! for all monies received). This also applies to enquiries which come through or are referred to you by parents/guardians of KidsArt! students. 

Termination:  Termination by notice for any reason on reasonable notice at the end of any term / holiday programme or by KidsArt! at any time during the term / holiday programme, if reasonable cause.

Studio & On-Line programmes & vouchers: booking & purchase terms


KidsArt! Studios:  These booking terms, as up-dated from time to time, apply to booking term-time classes and holiday programmes at each of our Studios and to our on-line programmes and store where applicable.

Bookings:  Bookings subject to availability – if a booking is made for a class which is full we will made immediate refund in full unless you would like to book an alternative class.   Please note all bookings (including for private lessons) should be made through KidsArt!; private bookings of KidsArt! tutors are not permitted.

KidsArt! On-Line:  Our on-line programmes provide a virtual in-studio experience.  We use Zoom conference and provide ID and password access to enrolled parents before each class, with children and their artwork visible to all participants.  Classes are designed to be interactive and, for this to work properly, parents should supervise younger children during the class.  Availability subject to platform functionality.  Price per screen for siblings only.

What’s included:  For Studio classes and programmes, tuition and materials (but no snacks).  For our on-line term-time classes we will provide a KidsArt! art pack for each child enrolled for the whole term for collection by parents by appointment from our Finchley Studio.  Other materials available for purchase from the KidsArt! Store.  Where your child is to attend a full day holiday programme, please provide a snack, but no nuts please. 

Fees:  Term-time classes payable termly in advance (trial lessons for one-off payment of £15.00 available on request). Holiday programmes as shown on holiday calendar: payable on booking on a ‘first come, first paid’ basis. We do not offer a reservation system.  Payment by bank transfer, cheque or PayPal voucher at the KidsArt! Store.

Child care vouchers:  Unfortunately we cannot accept vouchers.

Consent:  Booking implies consent to use of your child’s photo and art works on the KidsArt! website and Facebook pages and to record classes in which your child is participating for teacher training purposes unless (in the case of your child’s photo) you stipulate otherwise when booking. 

Cancellation policy: Fees are due once a booking is confirmed and, once booked, we do not refund fees. However, if you wish to withdraw your child from a holiday programme or class once booked, you are free to send another suitably aged child not already booked in your child’s place – just tell us first.  Occasionally, we may be forced to cancel a class for reasons beyond our control (eg illness, studio inaccessibility, travel disruption, adverse weather, unviable bookings nos., etc.), we will try to make alternative arrangements, including an on-line class or, if space permits, a “make up” class within the same term or holiday programmes – but this may be on a different day and at a different Studio.  (For private lessons, CV-19 cancellation and adverse weather cancellation for Finchley outdoor studio, see below).

Credits: We may occasionally offer a discretionary credit – this is accepted on the basis that it is only for the child who was booked, and that we cannot guarantee that it can be redeemed for classes at the same studio – we may offer you a different studio  

Missed term time classes:  We do not refund fees but will try (but no guarantees – subject to availability and your flexibility) to offer you a “make up” class to make up the missed class within the same term provided you have given prior notice of non-attendance – it may be on a different day and at a different Studio.

Private lessons:  Please note all private lessons must be booked via KidsArt! and tutors are not permitted to arrange private lessons whether for you own children or those you introduce without referring to KidsArt!  If bookings made via KidsArt! are cancelled more than 24hrs before the booked time and no fixed costs (e.g. studio hire; tutors fees) are incurred, we will offer a full credit note redeemable against lessons fees / art materials for a period of up to 12 months; in all other circumstances lessons booked should be paid in full if cancelled by you. Aprons are not provided as standard, but we can quote for aprons if you wish.  If the private lesson is in your home KidsArt! will not be responsible or accountable for damage to soft furnishings, wall paper, tables, chairs, floors or other surfaces etc. caused by paints or other art materials which we use.

CV-19 cancellation:  If, because of govt. guidelines or for Covid-related reasons we suspend face-to-face term time classes after the start of term or a pre-booked holiday programme, we will move to on-line classes instead, at same or similar times.  Please note, if this requires us to suspend:

— a term class, no refund will be due 

— a holiday programme, we will provide a voucher of £10 per child for use against any other session in that holiday programme 

(Note: in each case sibling discount for shared screen will not be offered.)

Adverse weather (Finchley outdoor garden studio):  If the weather is adverse (eg. strong wind, rain or cold), we may not be able to proceed with a Finchley Outdoor Garden Studio programme or we may need to curtail the session whilst it’s on-going.  If a session is curtailed in advance we will relocate to the indoor studio at Finchley if permissible in light of then current CV-19 measures, or if not permissible we will move the session on-line instead, at same or similar times. If the session is moved on-line we will provide a voucher of £10 per child for use against any other session in that holiday programme (sibling discount for shared screen will not be offered).  If a session is cancelled or curtailed and we do not relocate to the indoor studio at Finchley or move to on-line classes instead, we will let you know as soon as possible and if cancelled / curtailed  within the first hour of the session, we will provide a full credit for a future booking.  If we need to curtail a session after the first hour we would not unfortunately be able to provide a credit or refund. 

Allergies, medical conditions, etc:  Please inform us if your child suffers from any allergies or medical conditions of which we should be aware.

Artwork, personal possessions, etc:  You and your children should please take responsibility for taking home their artwork in good condition and all personal possessions (hats, coats, scarfs, shoes, etc.). Where works are left with us for drying/varnishing any uncollected works will be disposed of 3 months after we have notified you that they are ready for collection.  Work uncollected after a child leaves KidsArt will be stored and available for collection for 3 months after the child has left and then disposed of.  We cannot take responsibility for personal possessions left behind after sessions but will do our best to ensure that they are kept safely for collection within reasonable time; if not collected after 2 weeks they will be donated to charity 

Dress code:  Messy!  Kids, especially the younger ones, can brush up against paint, clay, etc. (we don’t provide protective aprons).

Tutors:  KidsArt! trained, vetted, experienced and approved. Occasionally we may need to change tutor allocations on the day.  Note: tutors are not permitted to arrange private lessons without booking via KidsArt! (as above).

Parking:  When dropping and collecting your child from our Studios please do not block neighbours’ drives at any time, even briefly – we have received a few complaints!

Allergies, medical conditions, etc:  Please inform us if your child suffers from any allergies or medical conditions of which we should be aware.

KidsArt! Vouchers: Vouchers purchased from the KidsArt! store may be used in the KidsArt! store or put towards weekly classes or holiday camps.  Unused vouchers expire after 3 years from date of purchase.  If store-items are not available the voucher may be used for weekly classes or holiday camps only and no cash refund will be given.

Welcome to www.kidsartuk.com (the Website). If you continue to browse and use the Website, you are agreeing to comply with and be bound by the following Terms of Use which, together with our privacy policy, govern KidsArt!’s relationship with you in relation to the Website.

These Terms of Use (these Terms) will also apply when you access the KidsArt! Store (the Store) or place orders to purchase any of the goods in the Store.

Please read these Terms carefully before using the Website and placing your order. By accessing any part of the Website or ordering goods from the Store, you agree to be bound by these Terms.

KidsArt!™ is the trading name and registered trademark of/used under licence by KidsArt Limited (registered in England, no. 10343048), 7 Westbury Road, London N12 7NY. References to ‘we’ and ‘our’ are to KidsArt Limited. References to ‘you’ are to the user or viewer of the Website.

The use of the Website is subject to the following terms of use:

  • The content of the pages of the Website is for your general information and use only. It is subject to change without notice.
  • Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information, including art exhibition reviews, Website content and goods found or offered on the Website for any particular purpose. KidsArt! Store

Our Contract

Your order constitutes an offer to us to buy the goods you select from the Website. All orders are subject to availability and will not constitute a binding contract of sale until accepted by us. We reserve the right to refuse to accept an order.

Purchases made on the Website are for your personal or gift use and are not to be used for re-sale, commercial purposes or any other commercial benefit.

The Order Process

You may select items from our range of goods, details of which will be added to the ‘Basket’ by clicking on the ‘Add to basket’ button. Once you have completed your selection and clicked on the ‘Show Cart & Checkout’ button you will be able to review all items in your ‘Basket’ and, subject to any changes, proceed to payment by clicking on the ‘Proceed to Checkout’ button. Before placing an order you can view and amend your order details at any time by clicking on the ‘Basket’ button.

By clicking on the ‘Proceed to Checkout’ button you submit an offer to buy the goods in the ‘Basket’. As soon as this offer is accepted by us, your order forms a binding contract of sale between you and us. You will be sent an e-mail confirming receipt of your order. This email does not constitute our acceptance of your order; it merely records the fact that we have received the order.

You will subsequently be told when your goods are available for collection/despatch which shall constitute our acceptance of your order, at which point a binding contract of sale will be concluded between you and us.

Delivery Times, Availability of Goods

We will do our best to accept your order receipt and confirm your goods are available for collection/despatch within 7 days of receipt.

Goods may vary slightly from their pictures. The images of the products on our Website are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee an exact match. Your goods may vary slightly from those images and we reserve the right to substitute equivalent goods of an equivalent type and quantity.

If for any reason the goods ordered by you are not available at the time you place your order, we will notify you of this by e-mail and we will endeavour to substitute equivalent goods of an equivalent type and quantity where we are able to do so. Our acceptance of your order is limited to the goods that are available (or their equivalent). No contract of sale will be concluded in respects of goods (or their equivalent) that are not available.

Delivery

All goods will be available for collection at the KidsArt! Finchley Studio, 7 Westbury Road, London N12 7NY and the prices of goods do not include delivery charges. Goods will not be posted unless you request postage.

If you do request postage, we will notify you of the additional delivery charge before your order is accepted. If you decide to cancel your order and return all of the items ordered, we will refund any delivery charges you have paid us.

Payment

We accept payment via PayPal or, where agreed, by direct bank transfer or in cash. We do not currently accept payment by credit card outside of PayPal.

14 Day Returns Guarantee

If for any reason you are unhappy with your goods, you have the right to return them within 14 days of your order being collected by/delivered to you and receive a full refund (including, where goods have been posted to you, any delivery charges you have paid us), provided:

  • the goods are returned in their original condition, have not been damaged, altered or used and include the original packaging and any related accessories; and
  • the goods are returned to KidsArt! Finchley Studio, 7 Westbury Road, London N12 7NY.

This is your ‘14 Day Returns Guarantee’.

We will provide you with a full refund within 30 days of receipt by us of the goods returned under your 14 Day Returns Guarantee. We will then send you an e-mail confirming that this refund has been made.

KidsArt! is under no obligation to accept returns and provide refunds for goods that do not comply with the provisions of your 14 Day Returns Guarantee. Goods that are not accepted by us will be returned to you. Your 14 Day Returns Guarantee does not replace, but is in addition to, your statutory rights.

Faulty Goods

If goods are faulty or do not meet the description given on the Website, please contact us as soon as possible at info@kidsartuk.com. We ask you to return the faulty goods to us and will then provide you with replacement goods where available, or alternatively give you a full refund for those goods (including, where goods have been posted to you, any delivery charges you have paid us).

Your Personal Data

We will only collect and use your personal data in accordance with our Privacy Policy.

Liability

When you order goods from the Website, our aggregate liability to you for any loss or damage arising in connection with these Terms shall be limited in respect of each claim relating to the goods to their purchase price (excluding any delivery charges).

Art exhibition reviews on the Website are offered free-of-charge for educational purposes only as the opinion of KidsArt! without liability.

We are not responsible for any delay or failure to comply with our obligations under these Terms if the delay or failure arises out of any event which is beyond our reasonable control. Such events shall include, without limitation, failure of supply for whatever reason, fire, flood, storms and accident. In addition, we will not be responsible for any loss or damage caused to you where such loss or damage is not reasonably foreseeable. We will also not be responsible for any loss or damage caused to you where you are not entering into these Terms and/or purchasing goods as a consumer.

We do not:

  • accept any liability for damage to your computer system or loss of data that results from your use of the Website;
  • guarantee which content and services will be available on the Website. All content and services on the Website are provided on an ‘as is’ and ‘as available’ basis;
  • guarantee that the Website will be available uninterrupted and in a fully operating condition nor that the information on the Website itself including art exhibition reviews will be free from errors or omissions (however, we will use all reasonable endeavours to correct any errors or omissions as soon as practicable once they have been brought to our attention).

Nothing in these Terms shall exclude or limit our liability for fraudulent misrepresentation or for death or personal injury resulting from our negligence.

Copyright/Intellectual Property Rights

Your use of the Website grants no rights to you in relation to copyright, design rights, trade marks or other of our intellectual property rights (or the intellectual property rights of third parties) including our rights in the KidsArt! registered trade mark and copyright and moral rights in art exhibition reviews.

We provide the Website to you solely for your personal, non-commercial use. The content of the Website including all text and images and other content, including art exhibition reviews, may not be used for any other purpose or copied or reproduced without our express written permission.

English Law

These Terms and any dispute arising out of them are subject to English law.
